Overview

POSITION OVERVIEW

Fidelity National Financial (FNF) is seeking a Deputy Regulatory Counsel to join our Southwest Region supporting our Texas, New Mexico, and Oklahoma operations. The Deputy Regulatory Counsel should possess a strong background in administrative law and be licensed to practice law in the state of Texas. This role involves providing legal advice, ensuring compliance with federal and state regulations, and representing the company in regulatory proceedings.

 

LOCATION

  • This is an onsite position at our Austin, TX office.

DUTIES & RESPONSIBILITIES

  • Monitor the Texas, Oklahoma, and New Mexico legislatures, track all bills that have an impact on the title insurance industry, and advocate for FNF’s interests in the policymaking process.
  • Revise legislation and propose statutory language as requested.
  • Report on and answer questions about legislative matters and actions by other regulatory bodies in the Southwest region.
  • Draft legislative update bulletins and manage lobbyist relationships.
  • Provide regulatory compliance counsel, draft regulatory guidelines, write compliance bulletins, and create reference tools.
  • Advise on licensing matters and assist with rate calculations and insuring form requirements.
  • Answer legal questions concerning Texas, Oklahoma, New Mexico, and Federal laws that are applicable to the business of title insurance.
  • Assist with and monitor regulatory filing for all license holders.
  • Prepare or assist with regulatory filings for affiliated agents, direct operations, and underwriters.
  • Assist in navigating TDI Compliance Audits, internal audits, regulatory inquiries, and enforcement actions.
  • Advocate on behalf of FNF and our independent agents before regulatory bodies and address MSAFs.
  • Advise on title insurance rate/rulemaking matters and represent FNF’s interests in title insurance rate/rulemaking discussions and proceedings.
  • Review consumer complaints, provide guidance for responding to complaints filed in Texas, Oklahoma, and New Mexico, comment on FNF Claims Attorney’s draft responses, coordinate with regulatory bodies as necessary, and provide legal counsel to FNF license holders as appropriate.
  • Draft, revise, and review contracts and forms as requested.
  • Maintain good relationships with industry associations and represent and advance FNF’s interests within those organizations.
  • Monitor, maintain, and improve the online database portals for entering data regarding directly issued policies, produce DIP reports for annual underwriter data call, and process all P-31 designations (e.g., authorized signatories for directly issued policies).
  • Create and present content regarding regulatory, legislative, and compliance issues that is eligible for continuing education credit on topics of interest.
  • Create and distribute compliance planning tools, checklists, and reminders.

MINIMUM REQUIREMENTS

  • Juris Doctor (JD) degree from an accredited law school.
  • License to practice law in the state of Texas.
  • In-depth knowledge of federal and state regulatory frameworks relevant to the company's operations.
  • Strong analytical, communication, and negotiation skills. Ability to work independently and as part of a team.

PREFERRED EXPERIENCE

  • Background in administrative law.
  • Experience in regulatory law and government relations.
